The “Appraisals and Assessments” area deals with all the problems that exist between individuals (e.g. relating to neighbourhood relations, to disputes, etc,…), and in cases where it becomes necessary to establish the value of an asset, of a service or a job through a logical, technical, scientific and reproducible process. The appraisals are prepared by Studio Tovaglieri and consist of background information regarding the issue and the technical and legal solutions to resolve the dispute (e.g. distances from boundaries,…).

The assessments consist of verbal and written advice which, by defining the specific characteristics of the goods being assessed and the choice of criteria and assessment methods (instrumental to the type of asset and for the purpose of the assessment), allow to clarify the value of the asset (e.g. estimate of the value of a property, estimate of the damage suffered or caused by an event or a person).

Appraisals in Legal Disputes

What does it involve

Boundaries not respected, plants poisoned, unpleasant smells or noises arising from activities on neighbouring properties and “difficult” relations with neighbours are just some issues that we have dealt with in twenty five years of business. Technical appraisals in legal disputes are of key importance to better solve both judicial and extrajudicial cases.

The various stages of the appraisal process consists in a detailed definition of the problem and the identification of both technical and legal solutions to solve the dispute.

In extrajudicial situations Studio Tovaglieri initially applies the “principle of dialogue” involving a meeting with the parties concerned, aimed at solving the problem by avoiding, if possible, legal action which is time consuming and the outcome is never certain.

Goods and Damages Estimate

What does it involve

An estimate involves defining the value of assets, services and damages and is one of the activities that Studio Tovaglieri has been performing for many years. We estimate the value of lands, farms, work and damage to property and crops due to adverse weather conditions and accidental or deliberate negligence.

Estimates consist in a preliminary inspection, performed by a highly skilled specialist, and a range of market analyses in order to evaluate the value. Very often these types of documents are aimed at economically quantifying the damage (or value) for insurance purposes or as a basis for setting up judicial and extrajudicial proceedings.

Consultation for estimates, damages and advice

What does it involve

When clients are still unsure whether to ask for a complete estimate or for advice on the value of an asset, a service, or the economic and technical advantage of an estimate, Studio Tovaglieri offers a consultation service.

This service consists in the inspection and evaluation carried out by a specialist to define the value, damage or economic advantage of an estimate or an investment.

The purpose of this consultation is to have a technical specialist opinion on the matter which highlights the strong points and critical issues of the asset being examined, providing useful information in order to make informed choices.

Determining Compensation for Expropriation and Easement (only in Italy)

What does it involve

Expropriation for the implementation of work that is of public interest consists of the “forced” transfer of ownership between the owners of the assets and the expropriating authorities, prior to the payment of a fair compensation to those expropriated, whether they are owners or managers of the land. Expropriation compensation and easement are defined and promoted by each of the parties according to their own criteria and objectives. The Consolidated Act and the current bibliography well define the boundaries within which one can operate in order to find a satisfactory agreement, if possible, with the help of professionals.

Studio Tovaglieri has dealt with dozens of cases assisting those who have been expropriated in obtaining a fair compensation for the loss of values they had initially underestimated.
